Refund and Cancellation Policy for AIWaveSa

1. OVERVIEW

At AIWaveSa, we strive to provide high-quality AI training and educational resources. This policy is drafted in accordance with the Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECT Act) of South Africa.

Because our services involve digital content, intellectual property, and scheduled live sessions, the following terms apply to all purchases.

2. ONLINE COURSES (SELF-PACED/PRE-RECORDED)

In terms of Section 44 of the ECT Act, a consumer is entitled to a 7-day cooling-off period. However, this does not apply once the digital service has begun with the consumer's consent.

  • Before Accessing Content: You are eligible for a full refund within 7 days of purchase, provided you have not logged into the student portal or accessed any course materials.

  • After Accessing Content: Once a student has logged into the training platform, viewed a lesson, or downloaded course materials, the service is deemed "consumed." At this point, no refunds will be issued due to the proprietary nature of the intellectual property.

3. LIVE WORKSHOPS & WEBINARS (SCHEDULED)

For live AI training sessions (Online or In-Person), the following cancellation fees apply to cover administrative costs and reserved seating:

  • Cancellation 7+ days before the event: Full refund or free 1-time reschedule to a future date.

  • Cancellation 2–6 days before the event: 50% refund or a 25% rescheduling fee.

  • Cancellation less than 48 hours before the event (or No-Show): No refund will be issued.

4. CORPORATE & CUSTOMIZED TRAINING

In accordance with Section 42(2)(f) of the ECT Act, there are no refunds for services made to the consumer’s specific specifications. This includes:

  • Bespoke AI training modules created specifically for your company.

  • One-on-one private consulting/coaching sessions already conducted.

  • Customized AI implementation strategies.

5. TECHNICAL ISSUES & DEFECTIVE ACCESS

If you are unable to access your training due to a technical fault on our side:

  • We will first attempt to resolve the issue within 48 hours.

  • If we cannot provide access to the purchased material due to a permanent technical failure of our platform, a full or pro-rata refund will be issued in accordance with the CPA.

  • Note: We are not responsible for technical issues arising from the user's internet connection, outdated hardware, or third-party AI tool outages (e.g., ChatGPT or Midjourney being down).

6. HOW TO REQUEST A REFUND

To log a request, please follow these steps:

  1. Email: Contact [Insert Email, e.g., support@aiwavesa.co.za] with your Order Number and the reason for the request.

  2. Review: Our team will verify your "Student Activity Log" to see if the content has been accessed.

  3. Approval: We will notify you of the approval or rejection of your refund within 3 business days.

7. REFUND PROCESSING

  • Approved refunds will be processed via the original payment method (PayFast, Yoco, or EFT).

  • Please allow 5 to 10 working days for the funds to reflect in your account, depending on bank processing times.

  • Any non-refundable transaction fees charged by third-party payment gateways may be deducted from the total refund amount.

8. RIGHT TO TERMINATE

AIWaveSa reserves the right to remove a student from a course or workshop without a refund if they:

  • Violate intellectual property rights (sharing login details or recording sessions without permission).

  • Engage in disruptive or abusive behavior during live training sessions.
